ASSUMPTION of RISK POLICY
For the duration of this document, the Fighting Chance Baby Bank – a charitable organisation (CIC) based at GU28 0AP, shall be referred to ‘us’, ‘we’, ‘baby bank’, ‘FCBB’ or ‘Fighting Chance Baby Bank’. The term ‘you’ and ‘your’ relates to the individual or family unit in receipt of donations and/or collecting those items from our hub or receiving delivery.
At the Fighting Chance Baby Bank we passionately believe in what we do – providing help and support to local families with babies and young children in need. In order to effectively provide as much aid as possible to local families, we need to ask you to understand, consider and agree to assumed risks regarding the goods provided by us to you.
It is really important you take the time to understand this document and that you ask any questions wherever you may be unsure before agreeing to this document.
We have an established risk assessment in place to check the quality and standards of all items. Unfortunately, we can’t accept liability for any items you receive in any aspect, shape or form. All items are provided without warranty or guarantee. This means it is your responsibility to check all items are safe and appropriate for yourself and your child.
You MUST;
• Thoroughly check all items for damage before use.
• Discard and report to us any items that appear defective, damaged or soiled.
• Check all items are age appropriate and fitting to your individual child.
• Wash all clothing, sheets, sleeping bags etc before use. Even if they appear clean they may have been stored for a long time.
• Clean and wipe down all items that cannot be washed.
• Ensure you understand how to safely and effectively use everything you have received. Please find the instruction manual online or ask us to send you a copy if you can’t find it. • Ensure the formula you are given is suitable for your child. Check the ingredients for allergens. Check the expiry date.
• Ensure that all toiletries are suitable for yourself and/or your child. Check the ingredients for allergens. Check the expiry date.
• Make us aware of anything that may affect the products we offer you e.g. Allergens.
• Ensure that you take care to follow the safety instructions provided upon entry, including fire safety advice and accessibility notices when collecting items from our hub.
We will always do our best to provide items that are to the best of our knowledge in good working order but it is very important you exercise the prudence and diligence of any parent and that you thoroughly check everything we provide. Please do not assume that all items you receive will be suitable for your individual child(ren). You must follow the advice above before using any of the items you receive.

We understand all families will have different needs regarding the items they require from the Baby Bank. We will always do our best to provide as many of the items required as possible, but we won’t always be able to fulfil 100% of the referral.
By accepting any item or collection from us you agree that you have read, understand and are happy to assume this declaration unconditionally and without reservation.
PRIVACY and DISCLOSURE POLICY

1/ Fair Usage of Data & Information
Fighting Chance Baby Bank only collect information and data on the families that use our services at a necessary and minimal level. We collect only reasonable, necessary information to ensure we can provide items or donations in a controlled, suitable way. We may ask for optional extra information from time to time in the format of a survey. This is used to help us understand larger trends – such as background, family situations and housing matters. Any such data is optional and anonymous. You are not obliged to provide any information that is not primary and not directly in aid of us providing the service of donations and items to you. You have the right to ask what information we hold for you at any time and may do so in writing by emailing us. Any fair request will be serviced for free within 28 days of receiving your email.
Information on individuals is only ever transmitted and stored on our servers and services in encrypted formats. This means we use only credible, enterprise-level software backed up with the latest in digital security tools to safeguard information. We may use the services of the Fighting Chance Foundation, a charitable company registered in England and Wales under the registration number 14033300. The Foundation provides us with the office space and digital infrastructure needed to run the Baby Bank effectively. Their privacy policy, confidentiality agreements and use of information far exceeds our control measures. They will however not have direct access to any information intended for us.
2/ Confidentiality
Unless specified otherwise, any communication with us or any of our volunteers is done in complete confidence. This means we won’t share any information about you with any other third party organisations or individuals, except in severe and emergency situations. This is covered in point 3. Internally, we will only share information on you or your referral on a ‘need to know’ basis to ensure we can help effectively. If you are referred to us by a third party organisation (for example, your midwife) we may need to continue communications with them in order to fulfil the referral in full however this agreement would also be governed by our strict confidentiality and ‘need to know’ basis.
3/ Safeguarding & Emergency Referrals
We assure everyone who uses our Baby Bank of confidentiality, dignity, and compassion. Part of our legal and moral duty of care to you requires us to make emergency referrals in certain circumstances. If we believe you, your baby or a member of your family is at risk of immediate harm we have a legal and moral obligation to escalate this through our safeguarding process. This may ultimately require us to refer on to the local authority designated officer (LADO) or the Multi Agency Support Hub (MASH). In the most severe circumstances, we would have to contact the emergency services. This is not a measure taken lightly or used without due cause. It is a mechanism in place to prevent immediate, serious harm to the families who rely on us. We know that when somebody is in crisis, we may need to step in and help. This is the only circumstance in which we will ever share information with third parties, and, in all cases, this will only be with official and formal services (I.e.: The Police Service, LADO, MASH and so on). We do not pass on personal information or circumstances on request from anyone unless there is an immediate danger to life or health.
REFERRAL FAIR USAGE POLICY
We will always do our best to help local families in need, however we may need to exercise discretion with regards to regularly occurring self-referrals. This will particularly be the case when we are busy or low on stock of items. This is to ensure that as many families as possible can access our services. We will always communicate this with you at the time of contact after a referral has been made.
FRAUD PREVENTION
Our resources are limited and we rely on our community for donations. We therefore have a duty to prevent fraud wherever possible. IP addresses are monitored and we may rely upon other fraud prevention measures if we suspect suspicious activity. We have the right to request photographic ID. Any suspected fraudulent referrals will be passed to the police,
DELIVERY POLICY
Deliveries are undertaken by volunteers and so availability will be confirmed at the time of referral. We cannot guarantee a delivery 100% of the time, in this situation a collection or delivery at a later point may be necessary. All volunteers will have photographic ID. Our Volunteers will not enter properties. The safety of our volunteers is paramount, and we reserve the right not to deliver when a driver feels threatened or at risk, or where a delivery address is not safe.
